Personal data (hereinafter referred to as "data") is processed by us only as necessary and to provide a functional and user-friendly website, including its content and the services offered there.

Under Art. 4 No. 1 (EU) Regulation 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to only as "GDPR"), "processing" refers to any operation or set of operations which is performed with personal data, whether or not by automated means, such as collection, recording, organization, arrangement, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making data available, alignment or combination, restriction, erasure or destruction.

With the following privacy policy, we inform you in particular about the nature, scope, purpose, duration, and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of processing. In addition, we inform you below about any third-party components used by us for optimization purposes and to increase the quality of use, insofar as third parties process data on their responsibility.

Our data privacy statement is divided into the following categories:

I. Information about us as the responsible party

II. Rights of users and concerned third parties

III. Information on data processing

I. Information about us as the responsible party

The responsible provider of this website in terms of data protection law is:

E-Mail: info@mr-hear.com

II. Rights of users and concerned third parties

Concerning the data processing described in more detail below, the users and data subjects have the right to

  1. confirmation of whether data relating to them is being processed, obtain information about the data processed, to further information about the data processing and to copies of the existing data sets (cf. Art. 15 GDPR);

  2. to correction or completion of incorrect or incomplete data (cf. Art. 16 GDPR);

  4. to receive a copy of the data concerning them and provided by them and to transfer this data to other providers/controllers (cf. Art. 20 GDPR);

  5. to file a complaint with the supervisory authority if they believe that the data concerning them is being processed by the provider in breach of data protection provisions (cf. Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider about any correction or deletion of data or restriction of processing that takes place based on Articles 16, 17 (1), 18 GDPR. However, this obligation does not exist insofar as this notification is impossible or involves a disproportionate effort. Notwithstanding the above, the user has a right to information about these recipients.

Likewise, according to Art. 21 GDPR, users and data subjects have the right to object to the future processing of data concerning them, insofar as the data is processed by the provider under Art. 6 I lit. f) GDPR. In particular, users and data subjects may object to data processing for direct marketing.

III. Information on data processing

Your data processed during the use of our website will be deleted or blocked as soon as the purpose of the storage no longer exists, the deletion of the data does not conflict with any statutory data retention obligations, and no other information on individual processing procedures is provided below.

Server data

For technical reasons, in particular to ensure a secure and stable Internet presence, data is transmitted by your Internet browser to us or to our web space provider. With these so-called server log files, we obtain data about the type and version of your Internet browser, the operating system, the website from which you have accessed our website (referrer URL), the website(s) connected to us that you visit, the date and time of the respective access and the IP address of the Internet connection from which the use of our website takes place.

The data collected is then stored temporarily, but not in combination with other data we may have on you.

This storage takes place on the legal basis of Art. 6 I lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data is deleted again after seven days at the latest unless further storage is required for evidence purposes. Otherwise, the data is exempt from being deleted fully or partly until the incident has been clarified.

Cookies

a) Session-Cookies

Our website uses cookies to enhance performance. Cookies are small text files or other storage technologies that are placed and stored on your device by the Internet browser you use. Through these cookies, certain information from you, such as your browser or location data or your IP address, is processed to an individual extent.

This processing makes our website more user-friendly, effective, and secure, as the processing enables, for example, the reproduction of our website in different languages or the offer of a shopping cart function.

The legal basis for this processing is Art. 6 I lit b.) GDPR, insofar as the cookie data is processed for contract initiation or contract execution.

If the processing does not serve the purpose of initiating or executing a contract, our legitimate interest lies in improving the functionality of our website. In this case, the legal basis is Art. 6 I lit. f) GDPR.

These session cookies are immediately deleted once you close your internet browser.

b) Third party cookies

Where applicable, cookies by third-party partner companies with which we cooperate for advertising, analysis, or the functionalities of our website are also used on our website.

For further details, in particular the purposes and legal bases of the processing of such third-party cookies, please refer to the following information.

c) Redress

You can prevent or restrict the storage of cookies by adapting the settings of your internet browser. Likewise, you can delete already stored cookies at any time. However, the steps and measures required for this action depend on the type of Internet browser you use. If you have any questions, please use the help function or documentation of your Internet browser or contact its developer or support. In the case of so-called flash cookies, processing cannot be disabled via the browser settings. Instead, you must change the settings of your flash player. The steps and measures required for this also depend on the specific flash player you use. If you have any questions, please refer to the help function or documentation of your flash player or contact the developer or user support.

However, if you prevent or restrict the storage of cookies, this may keep you from fully using all functions on our website in so far as cookies are used to enhance performance.

Contract execution

The data provided by you in connection with the purchase of our goods and/or services will solely be processed to execute the contract. Conclusion and execution of the contract are not possible without the provision of your data.

The legal basis for the processing is Art. 6 I lit. b) GDPR.

Once we have executed our contractual obligation, we delete your data but must observe potential retention periods under tax and commercial law.

In the context of contract execution, we pass your data on to the transport company commissioned with the delivery of ordered goods or to the financial service provider, insofar as the transfer is necessary for the delivery of goods or payment purposes.

The legal basis for the transfer of data is Art. 6 I lit. b) GDPR.

Customer account / sign up

If you create a customer account with us via our website, we will collect and store the data you provide during registration (e.g., your name, address, or e-mail address) exclusively for pre-contractual services, for the fulfillment of the contract, or customer service (e.g. to provide you with an overview of your previous orders or to be able to offer you the so-called memo function). At the same time, we then store the IP address and the date of your registration along with the time you have accessed our website. Of course, this data will not be passed on to third parties.

In the course of the further registration process, your consent to this processing will be obtained and reference will be made to this data protection declaration. The data collected by us in this process will be used exclusively for the provision of the customer account.

Insofar as you consent to this processing, Art. 6 I lit. a) GDPR is the legal basis for the processing.

If the opening of the customer account also serves pre-contractual measures or the fulfillment of the contract, the legal basis for this processing is also Art. 6 I (b) GDPR.

The consent given to us for the opening and maintenance of the customer account can be revoked at any time with effect for the future under Art. 7 III GDPR. For this purpose, you only need to inform us of your revocation.

The data collected in this respect will be deleted as soon as the processing is no longer necessary. However, we must observe retention periods under tax and commercial law.

Newsletter

If you register for our free newsletter, the data requested from you for this purpose, i.e. your e-mail address and - optionally - your name and address, will be transmitted to us. At the same time, we store the IP address of the Internet connection from which you access our website as well as the date and time of your registration. During the further registration process, we will ask for your consent to send you the newsletter, describe the content in detail and refer to this privacy policy. We use the data collected in this process exclusively for sending the newsletter - your data will not be passed on to third parties.

The legal basis for this is Art. 6 I lit. a) GDPR.

Following Art. 7 III GDPR, you can revoke your consent to the sending of the newsletter at any time with effect for the future. To do so, inform us of your revocation or click on the unsubscribe link contained in each newsletter.

Requests for contact / Options

If you contact us via the contact form by e-mail, the data you provide will be used to process your request. The data is necessary for processing and answering your request - without providing your information, we can not answer your request.

The legal basis for this processing is Art. 6 I lit. b) GDPR.

Your data will be deleted once your inquiry has been conclusively answered and the deletion does not conflict with any statutory retention obligations, such as in the case of any subsequent execution of a contract.

Linking Social-Media via graphics or textlink

We also advertise on the social networks listed below. The integration takes place via a linked graphic of the respective network. The use of this linked graphic prevents an automatic connection to the server of the social network when a website featuring a social media advertisement is accessed to display a graphic of the respective network itself. Only by clicking on the corresponding graphic will the user be redirected to the service of the social network itself.

After the user has been forwarded, information about the user is collected by the respective network. It cannot be prevented that in this case personal data won't get processed in the USA.

This may initially concern data such as the IP address, date, time and pages visited. If the user is logged into his user account at the moment of access, the network operator may be able to assign the collected information of the specific visit of the user to the personal account of the user. If the user interacts via a "share" button provided by the respective network, this information can be stored in the user's user account and may be published. If the user wants to prevent the collected information from being directly assigned to his user account, he must log off before clicking on the graphic. In addition, it is possible to configure the respective user account accordingly.

„Facebook“-Social-Plug-in

We use the plug-in of the social network Facebook on our website. Facebook is an internet service of facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. In the EU, this service is operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, hereinafter both referred to as "Facebook".

The legal basis is Art. 6 I lit. f) GDPR. Our legitimate interest lies in the improvement of our website.

Facebook provides you with further information about the possible plug-ins and their respective functions at

https://developers.facebook.com/docs/plugins/

für Sie bereit.

If the plug-in is available on one of the pages of our website that you visit, your internet browser downloads a copy of the plug-in from Facebook's servers in the USA. For technical reasons, Facebook must process your IP address. In addition, the date and time of your visit to our website will also be recorded.

If you are logged in to Facebook while you visit one of our websites containing the plug-in, the information collected by the plug-in from your specific visit will be recognized by Facebook. Facebook may assign the information collected in this way to your user account. If you use the so-called "Like" button of Facebook, this information will be stored in your Facebook user account and possibly become visible. If you wish to prevent this, you must either log out of Facebook before visiting our website or prevent the loading of the Facebook plug-in by using an add-on for your internet browser.

Facebook provides further information on the collection and use of data as well as your rights and protection options in this regard in the privacy policy available at

Google Analytics

We use Google Analytics on our website. This is a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as "Google".

The Google Analytics service is used to analyze the usage behavior of our website. The legal basis is Art. 6 I 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

Usage and user-related information, such as IP address, location, time, or frequency of visits to our website, is transferred to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymization function. Through this function, Google already shortens the IP address within the EU or EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data may also be used to provide other services related to the use of our website and the use of the Internet.

Google states that it will not link your IP address with any other data. In addition, Google keeps a record of your IP address at

https://www.google.com/intl/de/policies/privacy/partners

Google provides you with further information on data protection law, including information on how to prevent the use of your data.

In addition, Google offers a website at

https://tools.google.com/dlpage/gaoptout?hl=de

offers a so-called deactivation add-on together with further information. This add-on can be installed with standard Internet browsers and offers you further control over the data that Google collects when you visit our website. The add-on tells the JavaScript (ga.js) of Google Analytics that information about the visit to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analytics services. If and which other web analytics services are used by us, you will of course also find out in this privacy policy.

BootstrapCDN

To optimize the retrieval speed, design and display of the content of our website on different end devices, we use the service BootstrapCDN, a Content Delivery Network ("CDN"). This is a service provided by StackPath, LLC, 2021 McKinney Ave. Suite 1100, Dallas, TX 75201, USA, hereinafter referred to as "BootstrapCDN".

To be able to deliver the content of our website quickly, the service uses so-called JavaScript libraries. In doing so, corresponding files are loaded from a server of BootstrapCDN, which records your IP address.

In addition, BootstrapCDN offers more information about data protection via

https://www.stackpath.com/legal/master-service-agreement/#privacy

The legal basis for this kind of processing of personal data is Art. 6 I lit. f) GDPR. Our legitimate interest lies in accelerating the loading times of our website as well as in its optimization.

To prevent the execution of the Java Script code of BootstrapCDN altogether, you can install a so-called Java Script blocker, such as noscript.net or ghostery.com. If you prevent or restrict the execution of the Java Script code, this may, however, for technical reasons, lead to the fact that possibly not all contents and functions of our website will be available to you.

jQuery CDN

To optimize the retrieval speed, design, and presentation of the content of our website on different end devices, we use the service jQuery CDN, a Content Delivery Network ("CDN"). This is a service of the jQuery Foundation, hereinafter referred to only as "jQuery". jQuery is distributed for the JS Foundation via the StackPath CDN.

To be able to deliver the content of our website quickly, the service makes use of so-called JavaScript libraries. In doing so, corresponding files are loaded from the CDN server, as far as they are not already available in your browser cache due to a visit to another website. In case of a connection to the CDN server, your IP address will be recorded. It cannot be ruled out that a connection is made to a server outside the EU.

The legal basis for this kind of data processing is Art. 6 I lit. f) GDPR. Our legitimate interest lies in accelerating the loading times of our website and optimizing it.

To prevent the execution of the Java Script code of jQuery altogether, you can install a so-called Java Script blocker, such as noscript.net or ghostery.com. However, if you prevent or restrict the execution of the Java Script code, for technical reasons this may prevent you from accessing all content and functions of our website.
